These Terms & Conditions ("Terms") govern all bookings, services, and interactions through the ClickKar website ("Platform"). By accessing or using the Platform, you ("Client") agree to these Terms.

1. Booking & Payments

  • A booking is confirmed only after a 30% advance payment via bank transfer, UPI, or other approved modes.
  • Remaining amount must be cleared before final delivery.
  • Prices depend on the agreed scope; changes in requirement, timing, or location may revise the quotation.
  • Offline and online payments are accepted.
  • Late payments may delay delivery and may attract a 5% weekly penalty.

2. Cancellations & Refunds

  • Cancellation ≥72 hours before shoot → 80% refund of advance.
  • Cancellation <72 hours → no refund.
  • Rescheduling allowed 48 hours prior, subject to availability.
  • Complaints must be raised within 3 days of delivery.
  • Refunds, if approved, will be issued within 10–15 working days.

3. Deliverables & Revisions

  • Standard delivery timeline: 15–20 working days.
  • One minor revision round included; further changes are chargeable.
  • Raw files are not shared unless separately purchased.
  • Deliverables remain on ClickKar servers for 30 days.
  • Creative elements (shots, edits, style) are at ClickKar's discretion unless a written brief is finalized.

4. Usage Rights & Copyright

  • Clients receive limited, non-transferable usage rights.
  • Copyright remains with ClickKar or the creator unless sold separately.
  • ClickKar may use the content in its portfolio unless the Client opts out in writing before the shoot.
  • Watermarked or unpaid files must not be posted publicly.
  • Commercial usage requires a separate licensing fee.

5. Client Responsibilities

  • Clients must ensure punctuality and provide all permissions and access passes.
  • Delays over 30 minutes may reduce coverage or attract overtime charges.
  • Clients must maintain a safe and respectful environment; harassment or misconduct leads to immediate termination without refund.
  • Any damage to gear or property caused by the client must be fully compensated.
  • For projects exceeding 4 hours, reasonable breaks and refreshments must be arranged.

6. Logistics & Shoots

  • Standard shoot duration: up to 8 hours/day.
  • Extra early, late-night, or multi-day shoots are chargeable.
  • For shoots outside the base city, clients must cover travel, stay, and meals.
  • Shoots may be rescheduled during unsafe weather or hazardous conditions.
  • ClickKar may replace the assigned photographer/videographer if required.

7. Platform Rules

  • All communication, negotiation, and payments must be done only through ClickKar.
  • Direct hiring or off-platform dealings with ClickKar professionals are prohibited.
  • Non-cooperation or long delays from the client may extend project timelines.
  • ClickKar is not responsible for delays caused by third-party vendors hired by the client.

8. Liability & Dispute Resolution

  • ClickKar's liability is limited to the amount paid for that specific booking.
  • ClickKar is not liable for delays, loss, or damages caused by:
    • natural calamities
    • equipment failure after delivery
    • client negligence
    • data corruption after download
  • All legal disputes will fall under jurisdiction of Maharashtra, India.

9. Privacy & Data

  • Client data is used only for service delivery and communication.
  • ClickKar adheres to the Digital Personal Data Protection Act, 2023.
  • Data is not sold or shared except when legally required.
  • Deliverables may contain metadata; clients must not remove or misuse this.

10. Amendments

ClickKar may update these Terms anytime. Continued use of the website constitutes acceptance of updated Terms.
